The present platform Terms and Conditions constitute a framework agreement between AVBOB and its User on the use of the platform at www.avbobstep12.co.za. The platform enables the user to make use of learning material as a supplementary teaching aid.

Terms and Conditions of Use

  1. While every effort has been taken to ensure that the learning material is up-to-date and aligned to South Africa's relevant educational guidelines, AVBOB, its affiliates, its employees and the organisers of the AVBOB STEP 12 project do not take legal responsibility for the contents thereof. These are a teaching aid and do not replace teaching.
  2. The structure and content of the learning material is based on the Curriculum and Assessment Policy Statement (CAPS) prescribed by the Department of Basic Education as a compulsory teaching and examination guide. The AVBOB STEP 12 learning material(s) are not subject textbooks and therefore, do not cover all the required information in the syllabus.
  3. AVBOB reserves the right, at any time, in its sole discretion to cancel, vary, suspend or modify the platform, including, without limitation, circumstances where AVBOB in its own opinion considers for any reason that the platform is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, pandemic, technical failures or any other causes beyond the control of AVBOB, which may corrupt or affect the administration, security, integrity or proper conduct of this platform or otherwise. Any notice of variation or cancellation will be posted on the platform.
  4. Without in any way expanding the aforegoing and without limiting any other limitation/restriction on your access to the use of the platform and platform functionality/services, the user may not: (i) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, or otherwise commercially exploit or make the platform learning material and/or platform functionality/services available to any third party.
  5. The platform may contain links to third-party material. AVBOB has no control over and assumes no responsibility for the content, privacy policies or practices of any third-party services. If the user gains access to a third-party service from this platform, the user does so at his/her own risk and the user understands that these terms and conditions do not apply to users’ usage of such sites.
  6. AVBOB, its affiliates, its employees and the organisers of the AVBOB STEP 12 project will not be liable for any claim, loss or liability (monetary or otherwise) sustained or incurred, direct or indirectly, as a result of, or in any way connected with the use of this platform. Each user indemnifies, holds harmless and releases AVBOB, its affiliates, its employees and the organisers of the AVBOB STEP 12 project from all such claims made or sustained as a result of using this platform, including breach of any third-party intellectual property rights or any warranty or representation being false or incorrect.
  7. By using this platform, the user warrants that he or she has read and understood the terms & conditions and agrees to comply with these terms and conditions. This clause shall survive the use of the platform.
  8. If any part of these terms and conditions is void and/or unenforceable, then that part will be severed and the remainder construed as if the severed part had never existed.

Data processing - Use of personal information

  1. A user’s personal information, as defined in the Protection of Personal Information Act of 2013 (POPI), may be collected, used and disclosed by AVBOB for purposes and other incidental functions incidental to the running of this project, including disclosure of the user’s personal information to other organisers in this project upon the consent of the user.
  2. By using this platform, the user (and if the user is under 18 years of age, the user’s parent or legal guardian) consents to AVBOB using and disclosing any part of the user’s personal information provided as set out above, including, without limitation, to the use in any communications, updates, publications, marketing or promotional activities associated with the Project and for user identification and reporting purposes for any and all downloaded material.
  3. A user may withdraw his or her consent to future use and disclosure of personal information at any time by written notice to info@avbob.co.za and, upon receipt of such notice, AVBOB will take reasonable steps to cease using and disclosing that personal information as soon as is reasonably possible. In some instances, AVBOB will not be able to cease the use or disclosure, for example, where information has been distributed to other organisers involved in this project and AVBOB shall as soon as reasonably possibly notify the user by written notice to ensure compliance with POPI.
  4. AVBOB may update and/or amend the Data Processing and Security terms where such change is required to comply with applicable law.
